A distinctive aspect inherent in the English and Welsh legal systems is the feature of County Court Judgements (CCJs). These are decisions taken by County Courts in relation to monetary claims advanced by citizens.

The two parties involved in this case are the creditor and the debtor, who may settle on the sum which is owed. There are cases in which an agreement is not reached, and so the issue goes before the court, which determines what the sum ought to be.

Whenever a debtor feels that the judge has set too much of a financial burden on him, he may apply for a reconsideration. This remedy allows the debtor to ask the court to lower the sum, on the ground that he cannot afford the current one. There is a period of fourteen days in which a reconsideration may be asked. No fees are attached to such a remedy.

The special Register includes all the CCJs which have been issued thus far. This instrument is very useful for credit agencies that wish to verify the financial record of any person who is listed within.

Unfortunately, debtors do not always pay their debts immediately. This would run counter to a CCJ, and thus a creditor has a remedy in such cases. He may file a charging order against the debtor, and also demand his employer to redirect a percentage of the debtor’s waged into the court’s bank account.

It is also possible to receive payment from the individuals who owe money to the debtor in question. Moreover, the judge may appoint a Bailiff who would have the authority to take the property belonging to a debtor and use such property to make good the debt.

A negative CCJ will inevitably have a negative mark on a person’s financial record. It is included in one’s credit file, and in order to remove it one needs to pay the owed amount within a twenty-eight-day period.

As a result, a CCJ which has been successfully followed will be marked as ‘Satisfied’ in one’s record. This is naturally much more desirable than a CCJ which remains unpaid, although in both cases there will be damage to one’s personal credit file, albeit to different extents.

As can be appreciated, it is crucial to attend to a CCJ as soon as possible. One may find great difficulties in securing some sort of credit in the six years following such a situation. Effecting regular payments to clear the debt is a positive approach to re-establish a good financial record.
